IDEAL TRIP TO DUBAI 2023

TERMS & CONDITIONS FOR ENTRY AND PARTICIPATION

1.1. The following terms and conditions apply exclusively to the Ideal Trip to Dubai Promotion (the “Promotion”). By participating in this Promotion, each Participant fully and unconditionally agrees to these Terms and Conditions and acknowledges that they have read, understood, accepted, and will fully comply with these Terms and Conditions.

1. Eligibility:

1.1  The Promotion is valid only in Ghana and participation in same is restricted to persons who are legally resident in Ghana.

1.2  The Promotion is open to all consumers of IDEAL Evaporated Milk in Ghana.

1.3  Employees and family members of employees of Nestlé Ghana Limited (“Nestlé Ghana”), distributors and direct wholesalers of Nestlé Ghana, Infinite Media and all other suppliers and third parties directly involved with the facilitation of the Promotion will not be eligible to participate in the Promotion.

Promotion Period:
2.1 The Promotion will run from 1st March, 2023 to 30th June, 2023 (the “Promotion

Period”).

2.2 Nestlé Ghana reserves the right to change the Promotion Period and anything pertaining to the Promotion should it deem same necessary and will notify the general public should any such changes be effected.

3. Promotion Mechanics

3.1 To participate in the Promotion, Participants are required to:

3.1.1 Purchase any of the following: IDEAL Original 150g, IDEAL Original 370g at any outlet across Ghana.

3.1.2 Peel the paper label to reveal a unique set of alpha-numeric characters (the “Unique Code”).

3.1.3 Dialtheshortcode*380*10#(the“short-code”)onthefollowingnetworks: MTN, Vodafone, AirtelTigo and Glo and follow the prompt to participate in the Promotion.

  1. 3.2  Participants stand a chance to win prizes in multiple draws such as cash reward via mobile money (the “cash reward”).

  2. 3.3  A Participant who wins the cash reward but whose phone number is not registered for mobile money transactions shall visit any Nestlé Ghana regional office within five (5) working days with a valid national ID card.

  3. 3.4  Instead of the cash reward, the Participant as described above shall receive a shopping voucher equivalent to the cash reward amount.

  4. 3.5  There shall be a Virtual Draw (the “Virtual Draw”). Winners selected from the Virtual Draw will win Flagship Prizes including a Trip to Dubai and electrical appliances. Winners will be contacted by the Lead Agency (TXT Ghana) to visit any Nestlé Ghana regional office to confirm their Mobile Money number.

  5. 3.6  Winners selected from the Virtual Draw are required to present a valid national ID card to redeem their Flagship Prize at any Nestlé Ghana regional office.

  6. 3.7  Winners for the Trip to Dubai and their respective selected partners must have a valid Ghanaian Passport with not less than six (6) months to expire.

  7. 3.8  Nestlé Ghana will facilitate the acquisition of Travel Visas to Dubai but will not be held liable for the Embassy’s refusal of any Participant.

  1. 3.8  Winners of the Trip to Dubai are required to be of absolute good behavior and must conform to the guidance and directives of the chaperone assigned by Nestlé Ghana before and during the trip to Dubai.

  2. 3.9  Nestlé Ghana will bear the cost of Visa Acquisition, Travel Fares, Accommodation, Feeding (breakfast, lunch and dinner) and travel tours selected by Nestlé Ghana.

  3. 3.10  Winners of the Trip to Dubai shall abide by the laws of the United Arab Emirates and will be fully liable and responsible if they are found culpable
    of committing any offence while in Dubai.

3.11 Winners of the Trip to Dubai shall not hold Nestlé Ghana liable for any accident, injury, theft or other perilous event of similar nature which may happen in Dubai.

4.Rules of Participation

  1. 4.1  There is no restriction on the number of times a Participant can participate in the Promotion.

  2. 4.2  Flagship Prizes are redeemable after Participants have visited any Nestlé Ghana regional office for identity confirmation.

  3. 4.3  Prizes including Flagship Prizes are not exchangeable or transferable.

  4. 4.4  Redemption is only valid during the Promotion Period unless Nestlé Ghana finds it expedient to communicate a new date.

  5. 4.5  A Participant who wins the cash reward after texting the Unique Code to the short-code can also be selected as a Winner of a Flagship Prize in the Virtual Draw.

  6. 4.6  Winners selected from the Virtual Draw will receive a call from a Nestlé Ghana representative to validate their mobile money number and present a valid national ID at any Nestlé Ghana regional office to claim their Flagship Prize.

  7. 4.7  Under no circumstances shall Winners selected from the Virtual Draw be required to make any form of commitment (be it monetary or otherwise) in order to redeem their Flagship Prizes. Any prompting of that sort is fraudulent. Participants are entreated to ignore such requests. Nestlé Ghana will not be held accountable for any commitment whatsoever Winners make to such fraudsters.

  8. 4.8  Nestlé Ghana reserves the right to terminate or temporarily suspend the Promotion in the event of technical or other difficulties that might compromise the integrity or operations of the Promotion.

  9. 4.9  Winners of the Virtual Draw cannot opt out of any Prize Presentation Ceremonies unless they forfeit their Prizes.

Release and Authorization

  1. 5.1  By entering the Promotion, Participants agree and give consent to the processing, communication, and publication of their names, social media handle/page, likeness, image, and/or voice (including photograph, film, and/or recording of the same) (“Personal Information”) in any media for an unlimited period at any time in Ghana through any medium of release (mass media, digital media, etc.). Nestlé Ghana will however not be liable for any unauthorized use, reproduction, adaptations, and publication of the images by third parties.

  2. 5.2  Nestlé Ghana is committed to safeguarding the Participants’ privacy and will process the Personal Information/Data of Participants in accordance with the Data Protection Act, 2012 (Act 843).

5.3 By entering the Promotion, each Participant releases and indemnifies Nestlé Ghana (including their officers, employees, and subcontractors) from and against all actions, liabilities, penalties, claims or demands the Participant may have against Nestlé Ghana or that Nestlé Ghana may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of participation in the Promotion or winning or failing to win a Prize to the fullest extent permissible by law.

6. Variation and Disqualification

  1. 6.1  Nestlé Ghana reserves the right to amend or withdraw the Promotion or any of the Prizes or to amend these terms and conditions in relation to any or all Prizes and activities with or without prior notice to the general public.

  2. 6.2  Nestlé Ghana reserves the right at its sole discretion to refuse to allow a Participant to redeem his or her Prize upon the following;

  3. Detection of fraud or attempted fraud relating to the Participants; or

  4. Any attempt to disrupt, tamper with or unfairly influence the promotion, or its

    operation, by a participant or

  5. Breach of any of these terms and conditions; or

  6. Such illegal circumstance as may be determined by Nestlé Ghana.

6.3 Nestlé Ghana shall further reserve the right, at its sole discretion to refuse a Participant his or her Prize upon the said Participant’s involvement in any of the following incidents:

  1. Actual or suspected fraud concerning the Promotion;

  2. Any attempt to disrupt, tamper with or unfairly influence the Promotion, or its

    operation mechanism;

  3. Breach of any of these Terms and Conditions; and

  4. Any other misconduct or unacceptable act as may be determined by Nestlé Ghana.

  1. 6.4  In the event a Participant is disqualified from this Promotion, that Participant shall forfeit his or her Prize. In addition, Nestlé Ghana shall reserve the right to take appropriate legal action against the said Participant.

  2. 6.5  In the event of a discrepancy between these Terms and Conditions and the details in the Promotion material (or any other terms and conditions provided/referred to at the time of entry), these Terms and Conditions shall prevail.

7. Governing Law & Dispute Resolution

  1. 7.1  The Promotion and these Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Ghana and where any provision of the Terms and Conditions is declared by a court of competent jurisdiction as invalid, void, or unenforceable, the remaining provisions of these Terms and Conditions shall continue to be fully valid as possible.

  2. 7.2  All disputes, differences and/or claims, arising out of the Promotion and these Terms and Conditions, which are not resolved amicably within two (2) weeks of the dispute arising shall be resolved by an action in a court of competent jurisdiction.
